Space . . .


You were always a crackshot. You were always the ace.
Someone called you a crackpot. Said it right to your face.
It was not the effrontery that made you react;
The assault and the violation of rights.

In this wonderful country you and I live today.
Where we value the freedom which allows us to say,
Though the founders had principles, this can’t be denied.
Nothing’s frozen in time but history.
Who can really see that which the future brings?
Take that next shuttle. Go off to your condo on Mars.

Don’t take your guns to space.
They’ve done sufficient damage to this place.
Don’t take your guns to space.

It’s a volatile topic I’m addressing today.
But I fear to ignore it leaves for us hell to pay.
All the hunters and gatherers kick up such a stink.
Where this path’s gonna lead they dare not think.

We continue to venture into places unknown.
All this knowledge and progress takes us so far from home.
Many say that you must accept the good with the bad.
Seems to me that experience would show
Some things from the past don’t deserve to last.
Take that next step and leave all useless baggage behind.

Our sophistication in the arts and  the sciences can’t be denied.
Still we choose our tribal ways when there’s fear and uncertainty
That we must face. They’re true and tried.

But you still fail to grasp it like some new cosmic star.
Using force  laced with habit, you’re resisting so hard.
You say you got the word from some king high on a throne.
But mysteriously each word he speaks in that kingly tone,
Mighty but all alone, uncannily somehow sounds just like all of your  own.

Natalia Veselnitskaya, the Russian lawyer who attended the June 9, 2016, meeting at Trump Tower with Donald Trump Jr., has for years been working to overturn the Magnitsky Act, a 2012 U.S. law that barred Russian officials suspected of human rights abuses. . . is named after Sergei Magnitsky, a Russian lawyer and auditor who in 2008 untangled a dense web of tax fraud and graft involving 23 companies and a total of $230 million linked to the Kremlin and individuals close to the government. Magnitsky was the target of investigations, arrested by authorities and kept in jail without charges. He was beaten and later died under mysterious circumstances in jail just days before his possible release. . . The Magnitsky Act was signed by President Barack Obama in December 2012 as a retaliation against the human rights abuses suffered by Magnitsky. The law at first blocked 18 Russian government officials and businessmen from entering the United States, froze any assets held by U.S. banks and banned their future use of U.S. banking systems. The act was expanded in 2016, and now sanctions apply to 44 suspected human rights abusers worldwide. . ."

The Story . . .


. . . continues . . .


Question:  Sorry again for the long delay. Do you have a proposal drafted up that we would be able to review? After talking with my boss, the concerns would be from the promotional material, logo usage, etc. If you have a document going through all the requests and stipulations, would you be able to send that over?


Answer: The only proposal I can give you is the summary that I have already submitted. There is nothing complicated here.

This is a celebration of local musicians singing about their local environment.  Period.

I don’t understand concerns about promotional material, logo usage (you say etc. but if there is an “etc” could you please be specific.)

The CD will be promoted on cdbaby.com and on www.ohomusic.com described as above. Nothing more.

There will be NO LOGO usage. There need not be.

We have borrowed the basic melody of the fight song.  NOTHING MORE.

The rest of the fight song is poetic license.  Essentially jazz improvisation on chord substitutions for the basic, military march chords of the original.

Regarding ‘requests and stipulations’, I have stated our request.  We would like to purchase the mechanical rights, meaning, 'the right to reproduce a piece of music onto CDs, records or tapes.' Nothing more.

Please, if this is not clear, call me (or have your boss call).  I would be happy to speak with both (or either) of you.

Lest . . .

". . . even the most vehement rights defenders have barely mentioned the extrajudicial killings of Americans, the deaths of innocent civilians in the drone war, or indefinite detention. Yes, Obama ended Don't Ask Don't Tell, defended free speech on the internet, and bolstered socioeconomic rights with his health care plan — for this he deserves great credit. But supporters must be honest with themselves: overall, Obama has a very mixed rights record and we’ve done next to nothing to challenge him on it. . . . Human rights proponents who support Obama have fallen to the rabid partisanship that pervades this country; they are afraid to criticize “one of their own” too harshly for fear of losing political ground. This must stop. If we want to continue to create a more ethical society, all of us, regardless of political affiliation, must be courageous enough to challenge our leaders—even, nay especially, when we like them. If we support the principles, not the politicians, those politicians will be forced to become more principled."

Weirdness . . .

MLK, Gandhi, Mandela and all great opposition leaders throughout history have always preached this precept. Further, it is critical that in any democracy, investigation must be completed and due process must be honored before any government or police members are judged responsible. Cars were set on fire, store windows were shattered, a CVS drugstore was looted, and the cafe inside a century-old Italian deli was destroyed. Trouble also erupted at the city’s Lexington Market. . . Marc J. Randazza, a Las Vegas-based First Amendment attorney and managing partner of the Randazza Legal Group,  has in interesting take on the recent media storm NBA Clippers' owner Donald Sterling. 

First, many have questioned whether or not Sterling's First Amendment rights were violated.  Randazza says his First Amendment rights remain intact. The First Amendment protects you from punishment by the government because of your speech. The NBA is a private club, and it can discipline Sterling all it wants.  The government is not imposing the punishment in this situation.  Neither does the First Amendment insulate you from criticism. In fact, that's the First Amendment in action. 

Going one further though, Randazza says that what happened to Sterling may have been illegal and was morally wrong. In California, you can't record a conversation without the knowledge or consent of both parties. The recording featuring Sterling and V. Stiviano may be the result of a crime. We all say things in private that we might not say in public. Conversely, Nevada rancher Cliven Bundy made his own stupid and bigoted statements to the world by choice.  He deserves every ounce of obloquy heaped upon him. Complain about the National Security Agency spying on all of us yet we condone giving our closest friends the ability to do worse.

". . . President Barack Obama signed the National Defense Authorization Act of 2013 . . . giving his stamp of approval to a Pentagon spending bill that will keep Guantanamo Bay open and make indefinite detention for US citizens as likely as ever.

The president inked his name to the 2013 NDAA . . . to little fanfare, and accompanied his signature with a statement condemning a fair number of provisions contained in a bill that he nevertheless endorsed.

The NDAA, an otherwise mundane annual bill that lays out the use of funds for the Department of Defense, has come under attack during the Obama administration for the introduction of a provision last year that allows the military to detain United States citizens indefinitely without charge or trial for mere suspicions of ties to terrorism. Under the 2012 NDAA’s Sec. 1021, Pres. Obama agreed to give the military the power to arrest and hold Americans without the writ of habeas corpus, although he promised with that year’s signing statement that his administration would not abuse that privilege.

In response to the controversial indefinite detention provision from last year, Sen. Dianne Feinstein (D-California) introduced an amendment in December 2012 that would have forbid the government from using military force to indefinitely detain Americans without trial under the 2013 NDAA. Although that provision, dubbed the “Feinstein Amendment,” passed the Senate unanimously, a select panel of lawmakers led by Senate Armed Services Committee Chairman Carl Levin (D-Michigan) stripped it from the final version of the NDAA two week later before it could clear Congress.
