Some legalities. . .

Did you know?
Copyright shape the practices that drive the  music business from recording to touring deals. Washington has been passing and amending copyright laws regarding the music industry for more than a century. Still many artist know very little about copyright or rely on obsolete knowledge about those rules.

Copyright actually begins at the moment the music and lyrics are set down on paper, recorded, or stored on a computer.  Copyright protects the musician even if the song is never registered with the Copyright Office. The 'poor man's copyright' of ailing a copy of the work to yourself really does not provide any additional legal protection.

Copyright of a composition is totally different and separate from copyright of a sound recording. A sound recording can be considered a master recorded performance of the composition. Always be sure to protect the copyright of the composition separately from the sound recording.

The right to perform or play a song in public is one of the exclusive rights of the copyright holder. Permission or a license is required in advance music is to be played in public unless the music is in the Public Domain or the use of the music qualifies as fair use. But the line between what is private and what is public is complicated. Prior to the Music Licensing Act in 1998, some court cases have drawn the line and declared public uses of music to be copyright infringement unless licensed, as follows:

    Radio stations, bars, night clubs, and juke box operators;
    Hotels that play the radio for guests through speakers or headphones;
    Restaurants;
    Stores;

Although clearing one's throat is not necessarily considered aberrant behavior, it is not a normal everyday feature of the average person's speech. A healthy liar is more likely to do the "ahem" sound than a healthy non-liar. Psychological stress on a typical liar tends to put some tension on their muscular system, which includes their vocal muscles. The vocal muscles are miniscule in size, about the size of a thumbnail.1 The air you breathe passes through the vocal muscles on their way to the lungs and vice-versa. When the vocal muscles contract, they temporarily halt the respiration process; hence, the tensed liar may need to clear their throat in order to continue speaking.

Step 2: Creaky Voice Alert
Another common after-effect of lying and the anxiety associated with it on the vocal system is a creaky tone or a glottal fry.1 It is called so, because the voice then sounds as if it is being fried. The vocal chords try to minimize the impact of the lack of air by conserving it, resulting in a creaky voice. A physically healthy nervous liar is more likely than a relaxed physically healthy honest person to speak with a creaky voice.

Step 3: Judge in Context
While the typical liar's vocal features described in the previous steps can be a warning sign, they are to be analyzed within the proper context. There are many causes of the creaky voice and clearing of throat, and the anxiety that accompanies the act of lying is just one of them. Sickly honest people can just as easily experience these vocal problems as healthy dishonest people. In addition, there are experienced liars and pathological liars that are so used to lying that they have become immune to the anxiety that haunts the average liar. Therefore, the two vocal hot spots described in this page are meant to be used with an open mind. . . "

". . . Green Party candidate Jill Stein and her vice presidential running mate Cheri Honkala were arrested at the Hofstra University debate site today as they protested their exclusion from the second presidential debate.

Stein and Honkala were jailed for disorderly conduct around 3 p.m.  when they were blocked by police officers as they attempted to enter the debate hall, according to Stein’s campaign manager Ben Manski.

Manski said that it was unclear when they would be released, but they could remain jailed until midnight. The Nassau County Police Department said that it was unclear when Stein and Honkala might be released.

“The arrest was outrageous and shouldn’t be tolerated in a country that is a leading proponent of democracy,” Manski told ABC News. “They knew that there was the possibility that they would be arrested. Their intention was to enter the premises and bear witness to the mockery of democracy that is tonight’s debate,” he said.

The Green Party has long complained that the Commission on Presidential Debates attempts to “rig elections” in favor of the two major political parties by excluding third party candidates from debates. Stein and Honkala also planned protests at the first presidential debate in Denver.

Stein, a licensed physician, is on the presidential ballot in 38 states or 85 percent of the ballots, her campaign says.

The Commission on Presidential Debates was formed in 1987 to administer general election debates.

In addition to the constitutional criteria to be eligible for the presidency, the Presidential Debate Commission requires that candidates have a mathematical possibility of achieving the 270 electoral college votes necessary to be elected, and the candidates must have at least 15 percent support in public opinion based on the average of five national polls in order to participate. . . "

One Broken. . .

". . .The campaign of Independent candidate for the U.S. Senate Rob Sobhani today announced it has learned that both incumbent Senator Ben Cardin and the Republican nominee in the race told a Baltimore radio station – so far the only venue for a debate in Maryland’s senate race – that neither would appear if Rob Sobhani were allowed to share the platform with them.

This revelation comes in direct contradiction to the claims of the campaigns of Cardin and his Republican opponent that they are open to debating Sobhani, whom public opinion polling has clearly shown to be running dead even with if not ahead of the Republican nominee.

“This is precisely why Rob is running, to open up the closed system that takes voters for granted and plays rope a dope games whether at election time or when it comes time to actually govern on behalf of the citizens,” Sobhani spokesman Sam Patten said.  “Moreover, this is a clear indication that neither of these establishment politicians is being truthful with the media or the public on the subject of debates. As such, it is deeply disappointing.”. . ."

". . . As a contentious election season enters its final weeks, a flurry of communication from corporate leaders to rank-and-file workers strongly implies that voting for Obama could imperil their jobs and their financial stability.

Employees of a paper company owned by the outspoken billionaire Koch brothers received a mailing warning that they could “suffer the consequences, including higher gasoline prices, runaway inflation, and other ills" if they voted for candidates not supported by Koch-owned companies or its political fund-raising arm.

The company also provided workers with a list of those candidates it supports. At the top: Mitt Romney, according to media outlet In These Times, which broke the story. “The packet also included an anti-Obama editorial by Charles Koch and a pro-Romney editorial by David Koch,” it said.

“This is in no way an attempt to ‘intimidate’ employees,” Greg Guest, senior director of corporate communications at Georgia-Pacific, said in a statement on the site kochfacts.com.

"It's free speech. On the other hand, while it's maybe not directly intended to be intimidating, it can be intimidating," said Izzy Kushner, president of consulting firm HR Impact and president of the Human Resources Association of New York.

Although the Koch brothers are known for their outspoken support of the GOP, “Our support is not based on party affiliation, and we support both Republicans and Democrats who support market-based policies and solutions,” Guest’s statement said. . ."
