A federal appeals court ruled late Tuesday that presidential electors who cast the actual ballots for president and vice president are free to vote as they wish and cannot be required to follow the results of the popular vote in their states. . . The decision could give a single elector the power to decide the outcome of a presidential election — if the popular vote results in an apparent Electoral College tie. . ."

Trump . . . signed an executive order to end the large-scale practice of splitting up families at the US-Mexico border. . . claims will end family separation . . .The order doesn’t provide relief for the approximately 2,300 kids who have already been separated from their families since the administration’s policy was announced in early May. Those children will remain separated from their parents as they remain in federal custody and won’t immediately be reunited, according to a report in the New York Times. . . “There will not be a grandfathering of existing cases,” Kenneth Wolfe, a spokesperson for the Administration for Children and Families, a division of the Department of Health and Human Services. . ."

". . . 21 children are suing the US government in federal court, claiming it has breached its obligations to them under the Constitution to protect their civil rights. Specifically, they allege lack of government action on climate change is an infringement of their rights to life, liberty, and equal protection under the law. . . According to The Guardian, Julia Olson, the lead attorney for the plaintiffs told the press after the hearings, “What we have is not just a failure to act. The government is doing everything to fuel this problem.” She pointed to the permitting of oil and gas drilling and the export of fossil fuels, including the recently approved Jordan Cove Liquefied Natural Gas terminal in Coos Bay, Oregon, which the complaint says “enhances the cumulative danger” caused by the government’s actions. . ."

". . . While (the late Antonin) Scalia and (Dick) Cheney are avid hunters and longtime friends, several experts in legal ethics questioned the timing of their trip and said it raised doubts about Scalia's ability to judge the case impartially, the newspaper pointed out.

But Scalia rejected that concern Friday, telling the Times, "I do not think my impartiality could reasonably be questioned."

Federal law says "any justice or judge shall disqualify himself in any proceeding in which his impartiality might be questioned," the Times notes. . ."

The men were convicted by a jury of their peers in 2012 on arson charges stemming from a pair of fires (The Hammonds set ). . . that ultimately burned 139 acres of BLM (Bureau of Land Management) land. . . the federal anti-terrorism law that prosecutors used to punish the fires includes mandatory minimum sentences of 5 years for fires that damage public property but cause no injury or death. After a series of appeals, the Hammonds were re-sentenced in October of 2015 to the full five years required by that 1990s statute . . . Militia members have taken over the tile-roofed stone cottage on the south shore of the lake that serves as headquarters for the refuge . . . While frustrations and friction between federal land management agencies and ranchers are widespread, the vast majority of private citizens from communities affected by these issues do not share the radicalism that animates Bundy’s armed occupiers. . . The idea that federal authority over public lands is illegitimate has caught the attention of a variety of extremist groups that are convinced the government will sooner or later turn arms against its own people. . . "

Had the Supreme Court invalidated the subsidies in some 30 states operating on the federal insurance marketplace, that would have affected nearly 6.4 million Americans, who would have seen their health costs skyrocket by about 300 percent. Republicans were ready to blame Obama for the potential chaos. But some of them acknowledged the GOP would get the brunt of the blame, especially since they backed the lawsuit challenging the subsidies. "[Obama will] have the ads all racked up with the individuals that have benefited from Obamacare on the backs of the American taxpayer," Sen. Ron Johnson, R-Wis., admitted in an April interview. Republicans also had been divided on how to respond. Some like Johnson wanted to extend the subsidies for Americans - in exchange for repealing the law's individual mandate. But others were in favor of letting the subsidies die, full stop. . ."

Indyk slammed Republicans for crossing the line and disrespecting the president. “Netanyahu is using the Republican Congress for a photo-op for his election campaign, and the Republicans are using Bibi for their campaign against Obama,” Indyk said. . . In response, Chris Wallace said he agreed “100 percent,” with the statement and proceeded to express his own disappointment with what Boehner and the Republicans did. . ."

Stand Up . . .

The Vermont Legislature recently passed resolutions to overturn Citizens United v. Federal Elections Commission. . . you know. . . that's the one that gave birth to the Super PAC. Five Vermont Republicans actually voted in favor. IT says that the government should have the right to regulate corporate spending on elections and that the Supreme Courts ruling was based upon a faulty legal precedent when it equated campaign financing to free speech. The population of the state gathered at 65 town meetings in one day demanding a constitutional amendment. The resolution also states that corporations ARE NOT persons. Similar resolutions have been passed in over 100 cities in the U.S. while 20 more have introduced resolutions.

According to the latest jobs report, the US economy added 195,000 jobs in June and the unemployment rate holds at 7.6 percent...The unemployment rate remained unchanged at 7.6 percent, though the report was highlighted by the jobs figure, which outpaced most forecasters’ estimates...the report on Friday offered a modest political boon to President Barack Obama. Despite dire warnings about the effect of the ongoing sequester – the automatic, indiscriminate cuts to federal spending that were enacted earlier this year – the economy continues to add jobs, though not at the type of robust pace that would be needed to further reduce the unemployment rate.

But Republicans seized on some indicators of persistent economic weakness in the jobs report, namely a surge in part-time workers reflected in the statistics, and an uptick in the U-6 unemployment rate from 13.8 percent in May to 14.3 percent in June. The U-6 rate is a broader measure of unemployment, which includes discouraged workers and the underemployed.

“There’s some good news in this report, but economic growth is still tepid, the unemployment rate is far too high, and the president continues to promote policies that undermine robust job creation,” said House Speaker John Boehner, R-Ohio, in a statement..."

No person, corporation, or business entity, domestic or foreign, shall be allowed to contribute money, directly or indirectly, to any candidate for federal office or to contribute money on behalf of or opposed to an type of campaign for federal office. Notwithstanding any other provision of law, campaign contributions to candidates for federal office shall not constitute speech of any kind as guaranteed by the US constitution or any amendment to the US constitution. Congress shall set forth a holiday for the purpose of voting for candidates for federal office.
