The Utah Supreme Court filed its court ruling this past week on Judge Michael Kwan’s actions. . . Kwan, who has served as a justice court judge in Taylorsville for 20 years, was cited for “improper use of judicial authority and his inappropriate political commentary,” the latter often involving President Trump. . . The court noted multiple times when Kwan had provided political comments that criticized Trump, as a presidential candidate in 2016 and as president on his Facebook page and in court. . . Three days after the 2016 election, Kwan wrote on Facebook, “Think I’ll go to the shelter to adopt a cat before the President-Elect grabs them all” — a reference to the "Access Hollywood" tape in which Trump was heard bragging about grabbing women's genitals without consent. . . Almost a month after Trump’s inauguration, Kwan said “welcome to the beginning of the fascist takeover” and questioned whether Congressional Republicans would be “the American Reichstag,” this time referring to the political body of Nazi Germany. . . Judge Kwan defended his online commentary by stating that he had a First Amendment right to share his views about elected officials' political and social stances, calling it “constitutionally protected speech” and describing his statements as “social commentary or humor.” . . . He declared on PBS that the Second Amendment "has been the subject of one of the greatest pieces of fraud, I repeat the word fraud, on the American public by special interest groups that I have ever seen in my lifetime.". . . But that all changed with some scholarly work and cases brought by gun rights advocates. . . In 2008, in District of Columbia v. Heller, the court said there is an individual constitutional right to have a handgun in one's home for self-protection. Two years later, in a second case, the court made clear that its decision applied to the states as well as the federal government. . ."

Briefly, the 25th Amendment allows the Vice President and a majority of the Cabinet to tell the President pro tempore of the Senate (Orrin Hatch) and the Speaker of the House (Paul Ryan) in writing that the President is “unable to discharge the powers and duties of his office.” If the President doesn’t agree, he has the option of telling the President pro tempore of the Senate and the Speaker of the House, “not so fast, I’m fine.” . . . At that point, Congress acts as a tie-breaker and determines within 21 days whether or not the President is indeed unfit. . . the legal standard in question is vague and has never been tested. Scholars and politicians have little guidance at the exact moment that they need it most. . . . In the absence of such guidance, some have worried that if we invoke the 25th Amendment based on mental illness, we could be setting a dangerous precedent. Put another way, people fear the 25th Amendment will become a partisan sword. Luckily, these fears are overblown. Let us remember who invokes the 25th Amendment — the Vice President and the Cabinet, both individuals hand-picked by the President. This is unlikely to be a group eager to usher the President out the door. And if, despite historical evidence to the contrary, the President's Cabinet does go rogue, Congress can still act as a safety valve. . . "

And while SCPOA members have the right to quit their second jobs as private security for the 49ers, their union should be careful about establishing a precedent that they have the right to work free of criticism. If they want to quit, they should quit, and let the 49ers hire new security guards. But they, and we, should also remember that the First Amendment runs both ways . . . "

It's time for everybody to write to their representatives in Washington DC to encourage initiation of:

Amendment XXV

Section 4.   to the U.S. Constitution

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

If you think your voice doesn't matter, or if you think (and I've heard a multitude of rationalizations) that this cannot be done, then of course, nothing will be done. I know Congress has a majority of Republicans, but let us NOT generalize. We all agree that generalization is not applicable to races, colors, creeds, national original, profession, sex or tribe in this, the year 2017. Rest assured that there are members of the Republican party or or rational, reasonable people. Further, if your rationalization originates from places other than the political makeup of Congress, remember that if we do not try to do what is right, and refrain from making even the slightest effort to stop this nonsense, we will in the end, receive exactly what we deserve.

If you do not agree, than you are bad and you are wrong. 2016 Republican Presidential candidates said,
Sen. Marco Rubio said Obama is "obsessed" with "undermining" the second amendment.

Former Florida Governor Jeb Bush . . . accused Obama of “trampling on the Second Amendment.”

Sen. Ted Cruz tweeted, Fight back against @BarackObama's unconstitutional #2A executive action

Ben Carson argued on Twitter that Obama’s proposal will "regulate" freedom.

Carly Fiorina tweeted, Another lawless, unconstitutional overreach. The 2nd Amendment is an individual right.
