(to the) millions across America desiring stricter gun laws . . . the Constitution is no impediment to reform. . . all-out bans on assault-style weapons — the kind accused gunman Nikolas Cruz used in his rampage at Marjory Stoneman Douglas High School in Florida — are perfectly in harmony with the law as it exists today. No need to wait for a broken Congress or an apathetic president to do something. States and localities can lead the way today. And they have. . . (Antonin) Scalia’s own opinion in District of Columbia v. Heller — his greatest originalist achievement, in the view of many — left ample room for the regulation of firearms. In a passage that has become a thorn in the side of gun-rights enthusiasts, Scalia warned that people shouldn’t read too much into the fundamental right that he had just helped announce. Among other caveats and restrictions, Scalia wrote, “long-standing prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms” were still fair game. . . Connecticut, legislators there and in New York sprang to action and passed stringent bans on assault-style rifles and high-capacity magazines — The statutory schemes were broad, defining “assault weapons” as any semiautomatic rifle with at least one “military-style feature” — a definition that rendered the arsenal of prohibited weapons decidedly large. In Connecticut, the ban singled out 183 specific firearms by make and model. Court challenges were of no use. Both laws survived judicial scrutiny, and the Supreme Court didn’t bother reviewing the statutes’ constitutionality. In a one-line order, the court refused to add the case to its docket. . . Maryland enacted its own sweeping set of gun-control measures in response to Sandy Hook and other tragedies, declaring that the right to bear arms doesn’t extend to firearms that otherwise belong in the battlefield. “Put simply, we have no power to extend Second Amendment protection to the weapons of war that the Heller decision explicitly excluded from such coverage,” . . . the Supreme Court again didn’t bother with the Maryland ban and left the ruling in place. And so it has been for the past decade or so. Over the supplications of the National Rifle Association and others who have implored the court to revisit Heller, the court has refused, time and again, to clarify its contours. Could it be that there’s nothing to clarify? Just last week, the Supreme Court declined an invitation to review a California law that imposes a ten-day waiting period before an individual may purchase a firearm. The justices didn’t explain why the case didn’t interest them — maybe the Parkland school shooting in Florida was on their minds — and so it fell to Justice Clarence Thomas to be the lonesome voice crying out in the wilderness. “The right to keep and bear arms is apparently this Court’s constitutional orphan,” Thomas lamented in a 14-page dissent that not even Justice Neil Gorsuch dared join. “And the lower courts seem to have gotten the message.”. . ."

More Fact . . .

". . . Article I of the US Constitution vests the power to set tariffs in Congress. The president has the power to impose tariffs at his discretion only because Congress has passed laws granting him that power. If Republicans in Congress think Trump has a bunch of dumb, destructive ideas about trade, they should pass new laws that strip him of that power. . . Trump is expected to justify his proposed metal tariffs by invoking a 1962 law that authorizes the president to impose tariffs unilaterally if doing so is necessary for "national security." Congress could pass new legislation that would require the president to seek a vote of Congress to certify his (bizarre) claim that our dependence on Canadian steel is a national security threat — and that would block his tariffs from going into effect absent such a vote. . ."

Trump railed on Twitter against Democrats . . . noting that his “Tax Cut and Reform Bill” was winning “great reviews.” . . . there wasn’t an actual tax cut and reform bill pending in Congress yet for Democrats to support or oppose. The legislation hadn’t been introduced. . . tweeted that the “approval process” for his tax reform package would soon begin, which, again, is not how Congress works. . . there is ample evidence, that the president of the United States really doesn’t understand the constitutional process, or even American history, much at all. . . at the age of 70 seemed surprised to learn that Abraham Lincoln was a Republican. . . there’s the issue of his own election and why he won it. A few years ago, private citizen Donald Trump attacked the Electoral College. . . Shortly after he lost the popular vote to Clinton, and quite unsurprisingly, Trump became a booster of the very same Electoral College, calling it “actually genius,” and claiming falsely to have won the largest Electoral College landslide since Ronald Reagan . . . If he truly understood how the Electoral College worked, and what it was intended to do, which he apparently doesn’t, the president could have made a much smarter argument about his victory: that he in fact won the popular vote in more states (30) than Hillary Clinton did (20). . ."

Write . . .


It's time for everybody to write to their representatives in Washington DC to encourage initiation of:

Amendment XXV
Section 4.   to the U.S. Constitution

Whenever the Vice President and a majority of either the principal officers of the executive departments or of such other body as Congress may by law provide, transmit to the President pro tempore of the Senate and the Speaker of the House of Representatives their written declaration that the President is unable to discharge the powers and duties of his office, the Vice President shall immediately assume the powers and duties of the office as Acting President.

If you think your voice doesn't matter, or if you think (and I've heard a multitude of rationalizations) that this cannot be done, then of course, nothing will be done. I know Congress has a majority of Republicans, but let us NOT generalize. We all agree that generalization is not applicable to races, colors, creeds, national original, profession, sex or tribe in this, the year 2017. Rest assured that there are members of the Republican party or or rational, reasonable people. Further, if your rationalization originates from places other than the political makeup of Congress, remember that if we do not try to do what is right, and refrain from making even the slightest effort to stop this nonsense, we will in the end, receive exactly what we deserve.

The Republican-controlled state Senate must vote an additional time on the measure before the MIssouri House can take it up. . .The senators' efforts had been praised by Missouri Gov. On Tuesday, January 5th, President Barack Obama said (among other things in his address regarding gun control measures),
". . . I believe in the Second Amendment. It’s there written on the paper. It guarantees a right to bear arms. No matter how many times people try to twist my words around — I . . . believe that we can find ways to reduce gun violence consistent with the Second Amendment. . . "


2016 Republican Presidential candidates said,
Sen. Marco Rubio said Obama is "obsessed" with "undermining" the second amendment.

Former Florida Governor Jeb Bush . . . accused Obama of “trampling on the Second Amendment.”

Sen. Ted Cruz tweeted, Fight back against @BarackObama's unconstitutional #2A executive action

Ben Carson argued on Twitter that Obama’s proposal will "regulate" freedom.

Carly Fiorina tweeted, Another lawless, unconstitutional overreach. The 2nd Amendment is an individual right.

Parties . . .

. . . we need more (than two) . . .

. . . if the media (and the electoral system) provided equal time and attention to ALL U.S. political parties instead of just the two with the most money,  the most ridiculous of them could objectively be identified for what it is . . .

". . . About a year ago, the Republican condemnation of President Obama shifted – “he doesn’t lead enough” was out, “he leads too much” was in. The more Obama’s policy agenda succeeded in practical terms, the more the GOP argued the president is a lawless, out-of-control tyrannical dictator, hell bent on limitless power without regard for the Constitution. This week, however, Republicans are disgusted by Obama’s lack of executive overreach. GOP lawmakers are suddenly convinced the tyrannical dictator needs even more sweeping powers to act unilaterally in matters of life and death. . .This isn’t so much an example of Republicans temporarily putting aside their principles for the sake of convenience. Rather, it’s fresh evidence that the principles themselves have always been a mirage. . .

Republicans think Obama must stop acting like a dictator and start working with Congress as the Constitution intended – unless we’re talking about wars, in which case Obama should go ahead and circumvent Congress as much as possible.

Republicans think higher deficits are an economic scourge – unless deficit financing advances conservative policy goals, in which case budget shortfalls are better left ignored.

Republicans think government spending is inherently wasteful and counter-productive – unless the investments are directed at their state and/or their policy priorities, in which case government spending is great.

Republicans think the big federal government shouldn’t interfere with local decision making – unless the residents of the District of Columbia make a decision the right disagrees with.

Republicans think Congress should take a leading role in economic policy – unless we’re talking about trade authority, in which case it’s time to curtail Congress’ influence and empower the lawless White House to do as it pleases. . . "

Serious ?. . .

When seeking advice on a serious topic, it only follows that you approach a "serious expert" on said topic.   DOESN'T IT??!!

Anchor Krishnan Guru-Murthy, Channel 4 News: "So do you carry guns routinely at home?"

Ice-T: "Yeah, it's legal in the United States. It's part of our Constitution. You know, the right to bear arms is because that's the last form of defense against tyranny. Not to hunt. It's to protect yourself from the police."

Anchor: "And do you see any link between that and these sorts of (Aurora-type) incidents?"

Ice-T: "No. Nah. Not really. You know what I'm saying, if somebody wants to kill people, you know, they don't need a gun to do it."

Anchor: "It makes it easier, though, doesn't it?"

Ice-T: "Not really. You can strap explosives on your body. They do that all the time."

Anchor: "So when there's the inevitable backlash of the anti-gun lobby, as a result of this instance, as there always is--"

Ice-T: "Well, that's not going to change anything. ... The United States is based on guns." . . ."
