For Educational . . .

. . . purposes only. . .

. . . on Charles Kushner, father of Senior White House Adviser to Donald Trump, Jared Kushner . . .
(from https://en.wikipedia.org/wiki/Charles_Kushner)
". . . In the summer of 2004, Kushner was fined $508,900 by the Federal Election Commission for contributing to political campaigns in the names of his partnerships when he lacked authorization to do so.[9] In 2005, following an investigation by the U.S. Attorney's Office for the District of New Jersey, U.S. Attorney Chris Christie negotiated a plea agreement with Kushner, under which he pleaded guilty to 18 counts of illegal campaign contributions, tax evasion, and witness tampering. . . The witness-tampering charge arose from Kushner's act of retaliation against William Schulder, his sister Esther's husband, who was cooperating with federal investigators; Kushner hired a prostitute to seduce his brother-in-law, arranged to record an encounter between the two, and had the tape sent to his sister. . . Kushner was sentenced to two years in prison[12] and served 14 months at Federal Prison Camp, Montgomery in Alabama before being sent to a halfway house in Newark, New Jersey to complete his sentence. . . He was released from prison on August 25, 2006. . .As a result of his convictions, Kushner was disbarred from practicing law in New Jersey, New York, and Pennsylvania. . ."

Update . . .

(from http://www.huffingtonpost.com/entry/steven-mnuchin-treasury-secretary_us_582caddbe4b058ce7aa8b9c0)
". . . Donald Trump said the system is rigged. . . hedge fund managers are “getting away with murder.” . . . he’d “tax Wall Street.” . . .called Washington D.C. corrupt and promised to “drain the swamp.” . . . said his opponent Hillary Clinton was too cozy with the banks, as epitomized by her closed-door paid speeches. . . said Clinton’s vice presidential nominee, Tim Kaine, was “owned by the banks” and that he, Trump, would break them up. Trump closed his campaign with an ad bashing Goldman Sachs and George Soros, using classically anti-Semitic phrases. . . And now, according to The New York Times, ABC and CBS, the president-elect has chosen a second-generation Goldman Sachs partner who worked for George Soros before starting a hedge fund and buying IndyMac, a failing California bank that made billions while foreclosing on homeowners after the financial crisis. . . Steven Mnuchin. . . "

(from http://www.nbcnews.com/politics/politics-news/donald-trump-proposes-two-illegal-responses-flag-burning-n689726)
". . . (Trump, the)president-elect advocates two blatantly illegal punishments for Americans engaged in free speech. . . "Nobody should be allowed to burn the American flag," Trump wrote on Twitter, "if they do, there must be consequences - perhaps loss of citizenship or year in jail!". . . There are no criminal consequences for flag burning, however, because the Supreme Court has twice ruled that flag burning is a type of political expression. That means it is protected from government punishment by the First Amendment, regardless of what Congress or the president thinks. . . "

Scorecard Update . . .

5.  With No Evidence, Trump Claims 'Millions' Voted Illegally

(from https://www.washingtonpost.com/news/fact-checker/wp/2016/11/27/trumps-bogus-claim-that-millions-of-people-voted-illegally-for-hillary-clinton/)
". . . This is a bogus claim with no documented proof. . . Snopes.com and PundiFact have already examined this claim, back when it was hot in the right-wing blogosphere, not a statement made by a future U.S. president. The whole thing started with a few tweets by Gregg Phillips, a self-described conservative voter fraud specialist. . . These claims were then picked up by such purveyors of false facts as Infowars.com, a conspiracy-minded website that, among other things, claims that no one actually died in a massacre at Sandy Hook Elementary School in Newtown, Conn. One article described Phillips as being affiliated with VoterFraud.org but in reality he says he is the founder of VoteStand.com, supposedly an app that detects vote fraud. Phillips also has claimed that Obamacare is the “biggest voter registration fraud scheme in the history of the world” because it provided opportunities for voter registration. . ."

Baggage . . .

(fromhttp://www.washingtonexaminer.com/a-brief-guide-to-clinton-scandals-from-travelgate-to-emailgate/article/2562906)
Foreign contributions were found to be made to the Clinton family foundation.

In 1993, first lady Hillary Clinton allegedly engineered the firing of seven employees of the White House travel office and the hiring of a firm with ties to the Clintons to replace them. Multiple investigations absolved the president of involvement but Hillary Clinton was found to have made false statements to investigators.

Hillary Clinton convened her task force to create her husband's national healthcare program, it included multiple representatives from government, the health and insurance industries and academics. Despite the obvious potential for conflicts of interest in closed deliberations, the task force's meetings were kept secret throughout its existence.

In the late 1970s and early 1980s, Bill and Hillary Clinton were associates of Jim and Susan McDougal in the Whitewater Development Corp., an Arkansas real estate investment firm that went under when McDougal's Madison Guaranty Savings & Loan was closed by federal regulators for illegal accounting. Taxpayers lost $73 million due to Guaranty.

Vince Foster was President Clinton's deputy White House counsel and long-time friend of Hillary Clinton. He committed suicide in 1993, and his body was found in a park just across the Potomac River from the White House. Files were also allegedly removed from his White House office before investigators were able to secure it as part of the official probe into his death.

Congressional and Justice Department investigators began issuing subpoenas in 1994 for Hillary Clinton's billing records as a partner in the Rose law firm at the center of the Whitewater scandal. She said her role was incidental, but when the records mysteriously turned upin the White House in 1996, they showed she met repeatedly with key figures in the scandal.

Seats on Commerce Department international trade missions were sold to corporate figures in return for big contributions to President Clinton's 1996 re-election campaign. Commerce Secretary Ron Brown, who was reported to have opposed the scheme, died when one of the missions crashed in Croatia, leading independent counsel Daniel Pearson to leave his investigation unfinished.

More than 800 people stayed overnight in the Lincoln bedroom of the White House during President Bill Clinton's tenure. At least $5.4 million in campaign contributions from many of those guests went into Clinton's re-election effort.

A close associate of Indonesian industrialist James Riady, Huang initially was appointed deputy secretary of commerce in 1993 to the Clinton administration. By 1995, however, he moved to the Democratic National Committee where he generated hundreds of thousands of dollars in illegal contributions from foreign sources. Huang later pleaded guilty to one felony count of campaign finance violations.

Charlie Trie raised hundreds of thousands of dollars in illegal contributions from foreign sources to Democratic campaign entities. He was a regular White House visitor and arranged meetings of foreign operators with Clinton, including one who was a Chinese arms dealer. His $450,000 contribution to Clinton's legal defense fund was returned after it was found to have been largely funded by Asian interests. Trie was convicted of violating campaign finance laws in 1998.

Johnny Chung gave more than $366,000 to the Democratic National Committee prior to the 1996 campaign, but it was returned after officials learned it came from illegal foreign sources. Chung later told a special Senate committee investigating 1996 Clinton campaign fund-raising that $35,000 of his contributions came from individuals in Chinese intelligence. Chung pleaded guilty to bank fraud, tax evasion and campaign finance violations.

Then-Vice President Al Gore repeated the phrase "there is no controlling legal authority" at least seven times during a news conference called to explain his multiple telephone calls from the White House to solicit contributions to the Clinton-Gore re-election campaign in 1996. In fact, the law was and remains clear that partisan campaign contributions cannot be solicited on or using federal property.

President Clinton became only the second chief executive ever impeached by the House of Representatives in 1998 after being found guilty of obstructing justice and committing perjury in connection with a grand jury investigation of his sexual relationship in the White House with an intern. Hillary famously blamed a "vast right-wing conspiracy that has been conspiring against my husband since the day he announced for president.”

Shortly before leaving the Oval Office, Bill Clinton issued a number of controversial pardons for controversial individuals represented by lawyers with ties to the administration. The most controversial wasconvicted tax evader Marc Rich who was pardoned after his former wife made big contributions to the Clinton presidential library and to Hillary Clinton's 2000 Senate campaign.

During her unsuccessful 2008 campaign for the Democratic presidential campaign, Hillary Clinton claimed to have come under sniper fire during her arrival as first lady at an airport in Bosnia in 1996. She recanted her claim after CBS News broadcast video of the arrival that demonstrated there was no sniper fire.

(from http://www.wicasta.com/blogs/is-afton-live-a-scam-any-worse-than-venues/)". . . Every band who has a web site, MySpace or ReverbNation page has likely heard from Afton Live. From what I can gather, the company mass e-mails bands, preying upon the younger musicians who are excited about playing anywhere at any time. If you decide to do a show, you quickly realize that you’re expected to sell tickets to the event. The more tickets you sell, the more money you make (though far less than Afton keeps, and far less than you’d make at a regular gig). The order that the bands take the stage is determined by who sells the most tickets. In short, what Afton Live does is book venues and then find bands to play on the bill; bands who are willing to sell tickets mostly to their friends and relatives, and then perform for next to nothing. Apparently there are plenty of bands out there who are willing to do just that. . .

In the final analysis, I believe that Afton Live is a scam. Not because people are being cheated, but because Afton Live preys upon the needs of up and coming musicians. Inexperienced musicians believe that all they have to do is keep playing, even if they have to do it for free, and they will eventually reach the big time. Sooner or later some producer will discover them and they’ll be on their way. So while what Afton Live does is not illegal in any way, it’s certainly immoral in my book. . ."

Both Sides. . .

So I've got to say that I certainly hear both sides of the debate (see Pianogonzology August 14th & 15th) and empathize with each.  Our society is all too quick to vilify and then we seek revenge.  (See Mel Gibson movies-Any)

While Anthony Weiner, Bob Filner and Eliot Spitzer have all done despicable deeds, some with more hubris than others, as Howard Bess says, dwelling on these things will only make us miserable human beings.

I certainly have no desire to bring additional or excessive misery upon myself.  First, and I'm sure Howard would agree, any illegal activity must not go unpunished.  And I most certainly believe Howard is spot-on that we must forgive and move on.  Based upon sincere remorse and a willingness to make amends (and restitution, if applicable) everyone deserves another chance.

What I have difficulty with, and I'm sure Howard is a much better man than I, is re-electing someone to the same position (or higher) when deficient remorse has been exhibited and excessive lack of scruples demonstrated.

Finger Pointing. . .

(from Howard Bess)
"Vic Kohring lives in Wasilla, Alaska, the city made famous by Sarah Palin.  He served seven terms in the Alaska State House of Representatives.  He was convicted of accepting illegal gifts.  He served his sentence in prison and has completed his parole/probation without violations of any kind.  All his rights as a citizen have been restored.  He now wants to run for a seat on the Wasilla City Council.
Bob Filner is the mayor of San Diego, California.  He served in the U.S. House of Representatives.  He served with distinction, but chose to leave Congress to run for the office of Mayor of San Diego.  It has come to light that he has been a habitual sexual harasser of women with whom he worked.  The charges are credible and there has been a loud cry for him to resign from his office of mayor.  He has apologized for his behavior and has no intention to resign.  He wants to be mayor of San Diego.
Anthony Weiner was elected to the U.S. House of Representative seven times.  When he was charged with inappropriate sexting on the internet, he resigned from Congress and returned to New York City.  When Weiner returned to New York City he continued his sexting activities under a different name.  He has decided that he wants to be mayor of New York City.
He has apologized for his sexting activities and promises never to do such things gain.  People are calling for his dropping out of the mayoral race.  To date Weiner refuses to be a drop out.
I do not approve of Vic Kohring accepting illegal gifts.  I do not approve of Bob Filner’s sexual behavior.  I do not approve of Anthony Weiner’s sexting.  However, if I dwell on the things that upset me, I will be a miserable human being.  The Israelite/Christian tradition makes it abundantly clear that all human being are flawed and fall short of the potential of their lives.
Some well-intentioned human beings are hung up on cleaning up everyone’s flaws except his/her own.  I am very skeptical about “clean up the mess” politicians and am even more concerned about “clean up the mess” religious leaders.  I love the list of the fruits of the Spirit that Paul enumerates in his Galatians letter.  Love, joy, peace, patience, kindness, goodness, faithfulness, gentleness, self-control.  I find no reference to judging and whistleblowing.  Judging and whistleblowing do have a spirit behind them, but it is clearly not the one that Paul calls the “Holy Spirit.”
What to do about what is wrong in the world is a major topic in the Bible literature.  There is disagreement about what should be done.  There were devout people who thought their God advocated killing or seriously penalizing the wrong doer.  Several of the Old Testament prophets disagreed, and for Jesus, the rabbi from Nazareth, punishment was counterproductive.  He was much more interested in restoring, reclaiming, and making the flawed persons whole.
Of all the stories that Jesus told, the one of first importance is the parable of the Good Samaritan.  I would place the parable of the wayward son in the second spot.  The son blew family money on riotous living and made a fool of himself with women.  When he came to his senses, he went home where his father welcomed him and restored him to the family.  To accomplish this, the father had to extend an abundance of grace.  The extension of grace to the unworthy is an essential part of the Christian tradition.
Kohring, Weiner and Filner made fools of themselves, but that does not mean that their value as human beings has been discarded.  It may be that Vic Kohring will be a good city council member.  Weiner may make an excellent mayor of New York City and Filner may do a good job as the head of the government in San Diego.  Is there a place for grace in American public life?
The United States is a nation of law.  However, it does not mean that we cannot be gracious within the framework of law.  Right now the mood of America is not to extend grace to anyone.  We have taken discretion from our judges and substituted mandatory sentences and absurd laws such as “three strikes and you’re out.”
One of the great hypocrisies of Christians and their churches is their finger pointing and judging.  The foundation of the Christian Faith is not being right and pure but being gracious.  Our Faith calls us to be witnesses about a different way to live.  That way of life is gracious and restores the fallen.
If grace is good for any of us, it has to be good for all of us.  All of us must include Kohring, Weiner and Filner."

(The Rev. Howard Bess is a retired American Baptist minister, who lives In Palmer, Alaska.  His email address is hdbss@mtaonline.net)

Is it me. . .

. . . or did EVERYBODY think that since insider trading is ILLEGAL, that members of Congress were NOT supposed to participate and should be, been and always be under particular scrutiny to guard against such a thing happening?????

VOTE THEM ALL OUT!!!!    WHO NEEDS THEM?????!!!!!

I CERTAINLY DON'T!!!!!

(from http://firstread.msnbc.msn.com/_news/2012/01/30/10273245-ban-on-congressional-insider-trading-clears-key-senate-hurdle)

A ban on insider trading by members of Congress cleared a key procedural hurdle Monday in the Senate, moving toward final passage and a House vote on similar legislation later next month. A bipartisan group of senators voted 93 to 2 in favor of ending debate on the STOCK Act, a piece of legislation meant to prohibit members of Congress, their families and staff from using any information gleaned while working on the Hill to execute stock transactions. The legislation 60 votes to attain "cloture," or limit debate and move toward final passage. The bill will be debated and amendments will be attached over the next week. It's unclear when the final vote will occur.

The House version will expand certain restrictions on insider trading to White House staff and is also expected to create clear restrictions on members of Congress making land deals using insider information. The House is looking to move on that legislation within a month. "Leader Cantor plans to move an expanded version of the STOCK Act through the House in February to make it clear that those in Congress are subject to the same laws as everyone else," Laena Fallon, a spokeswoman for Cantor's office told NBC. Fervor over insider trading on Capitol Hill reached a peak last fall following the airing of a "60 Minutes" segment questioning whether lawmakers including House Minority Leader Nancy Pelosi (D-CA) and Speaker John Boehner (R-OH) made investments based on their knowledge of legislative activity to which they would be privy.

Dear Mr. Jozwiak. . .

". . . The PROTECT IP Act (S. 968) would give the Department of Justice (DoJ) authority to identify and take legal action against websites that market counterfeit or pirated goods.

Illegal downloading of movies, TV shows and music is a real problem that harms industries, kills jobs and hurts our economy.  We need strong copyright laws to protect the creative property of artists, and it is important that these laws be followed.  However, I share your concerns about this bill.  We need to make sure that the solution isn't worse than the problem.  Any efforts to strengthen the protection of copyrighted materials must be well planned, avoid unintended consequences, and must not stifle free speech or innovation Legislation as wide-ranging as this needs a more open and thorough review from all sides of the debate.  I am pleased that Senator Leahy — the author of the bill — has said he is open to changes to address this and other issues.  The current language in the bill needs to be improved before I could consider supporting its final passage. . . "
Senator Barbara Mikulski

Dear Mr. Jozwiak,
". . .SOPA is a hard hitting attempt to address the legitimate problem of illegal downloads of copyrighted work like movies, television shows and music.  I believe that artists and the companies that create content should be able to protect their information.  However, this legislation forces Internet Service Providers (ISPs) to be the policing authorities on the beat to find, hunt, and shut down illegal pirate websites or the service provider is held liable for the copyright infringement. ISPs will have to maintain a list of banned websites.  While SOPA would act as a filter for offending websites, as soon as these websites are shut down, similar copies are set up very quickly. ISPs and the Department of Justice will spend their time going after pirate websites that can be renamed and changed in an instant.  I do not believe this is the most efficient way to solve the problem of piracy.

As ranking member of the House Permanent Select Committee on Intelligence, I work closely on various cyber security issues.  Both the Sandia National Laboratory and the Department of Homeland Security took the position that SOPA will hurt U.S. efforts to keep our networks secure and safe from serious cyber attacks. As it stands now, SOPA is a one sided firewall that would hinder our ability to go after the real offenders and threats to our networks, while simultaneously limiting innovation and free speech. I hope that all stake holders can sit down and develop a compromise solution that avoids these problems. . . "
C.A. Dutch Ruppersberger
Member of Congress

(from IndieMusic News)
". . . Lamar Smith, the chief sponsor of SOPA, said on Friday that he is pulling the bill “until there is wider agreement on a solution.”
“I have heard from the critics and I take seriously their concerns regarding proposed legislation to address the problem of online piracy,” Smith (R-Texas) said. “It is clear that we need to revisit the approach on how best to address the problem of foreign thieves that steal and sell American inventions and products.”
